Terms of Service / Terms of Sale

These Terms of Service / Terms of Sale (the “Terms”) govern your access to and use of the Istranslate website and related services (the “Service”), including the purchase and use of digital credits (“Symbols”).

1. Operator and Contact

The Service is operated by Nikita Arkhipov (individual), CPF 026.783.659-72, Av. Campeche, 555 - Campeche, Florianópolis - SC, 88063-301, Brazil (“Operator”, “we”, “us”).

2. Eligibility

You may use the Service only if you can form a legally binding contract in your jurisdiction. If you are under 18, you must have permission from a parent or legal guardian.

3. The Service

The Service provides AI-assisted translation and related features, including context explanations, and (when available to your account) voice transcription and text extraction from images.

4. Symbols (Credits) and Charging Rules

4.1. What are Symbols

“Symbols” are digital units that provide access to paid usage of the Service. Symbols are not money, not a bank account, and have no cash value outside the Service.

4.2. How Symbols are calculated

  • Text translation: charged by the length of the input text (sourceText.length) as measured by the Service at the time of request, including spaces and line breaks. Some characters (e.g., certain emojis) may be counted as more than one unit due to technical encoding.
  • Voice transcription: charged by the length of the output text.
  • Image text extraction: charged by the length of the output text.

4.3. When Symbols are charged

  • We charge Symbols only when the Service successfully returns translation/output content. If a request fails due to an error (e.g., limits, timeouts, upstream errors), we do not charge Symbols.
  • If a request returns partial content (for example, you stop the generation after some content is produced), the Service may still charge based on the applicable charging rule for that request.

5. Free usage and limits

The Service may allow limited free usage (guest and/or free quota). Limits may be enforced using technical identifiers such as device ID and IP address. Limits, quotas, and availability of features may change over time.

6. Purchases and Payment Providers

6.1. One-time top-ups

Symbols are sold as one-time top-ups. After successful payment and confirmation, Symbols are credited to your account balance and can be used for paid usage.

By completing a purchase, you request immediate delivery of digital content (Symbols) and immediate access to the paid Service. Where applicable, you acknowledge that statutory withdrawal/cooling-off rights may be limited once delivery/performance begins.

6.2. Payment providers

  • Stripe (bank cards). Prices are shown during checkout and processed by Stripe.
  • Telegram payments (Tribute / Stars). Payment initiation and confirmation are handled via Telegram and its payment mechanisms (for example, SBP in RUB via Tribute or Telegram Stars, depending on availability).

6.3. Taxes, bank fees, currency conversion

Your bank or payment provider may apply additional fees or currency conversion charges. Unless required by law, we do not provide tax invoices/receipts beyond what the payment provider supplies.

7. Delivery and technical issues

Delivery of Symbols occurs when your account balance is updated after a successful payment confirmation. If you believe Symbols were not delivered or were credited incorrectly, contact us via the Support Form.

8. Refunds and disputes

Refund rules are described in our Refund & Dispute Policy. In summary: unused Symbols may be refundable within 30 days; used Symbols are non-refundable.

9. Acceptable Use

You must comply with our Acceptable Use Policy. We may suspend or block access for abuse, fraud, chargeback abuse, or prohibited content.

10. User content and licenses

You retain your rights in text you submit. By using the Service, you grant us a limited license to process your content solely to provide, maintain, and improve the Service (including generating translations, storing history if enabled for your account, and fraud prevention).

You represent and warrant that you have the necessary rights and permissions to submit the content you provide to the Service, and that doing so does not violate any law, confidentiality obligations, or third-party rights.

11. AI outputs, disclaimers

  • The Service generates output automatically and may contain errors or inaccuracies.
  • Do not rely on the Service for high-stakes use cases (including medical, legal, financial, or safety-critical decisions). You are responsible for verifying outputs.

12. Limitation of liability

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”, and we disclaim all warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill.

To the maximum extent permitted by applicable law, our total liability for any claims related to the Service will not exceed the amount you paid to us for the Symbols that gave rise to the claim in the 3 monthspreceding the event.

Nothing in these Terms limits any mandatory rights you may have under applicable consumer protection laws.

13. Intellectual property

The Service, its design, software, and trademarks are owned by the Operator or licensors. You may not copy, reverse engineer, or resell the Service except as permitted by law.

14. Suspension and termination

We may suspend or terminate your access (including blocking accounts) if we reasonably believe you violate these Terms, our policies, or applicable law, or if necessary to prevent fraud or harm.

15. Changes

We may update these Terms from time to time. The “Last updated” date indicates when changes were made. Continued use of the Service after changes become effective constitutes acceptance.

16. Governing law and disputes

These Terms are governed by the laws of Brazil. To the extent permitted by applicable law, disputes shall be resolved in the competent courts of Florianópolis, State of Santa Catarina, Brazil.

17. Privacy

Our Privacy Policy describes how we process personal data. By using the Service, you acknowledge that we process data as described there.

Language clause: In case of any discrepancy, the English version prevails.
